THE GOVERNMENT REGULATION ON ANIMAL QUARANTINE

CHAPTER I
GENERAL PROVISION

Article 1

In this Government Regulation, the interpretation of :

CHAPTER II
QUARANTINE REQUIREMENTS

Article 2

Carrier media entered into the territory of republic of Indonesian must :

Carrier media brought in or that is delivered from one area to other area in the territory of Republic of Indonesia must :

Article 4

Carrier media that will be excreted from territory of Republic of Indonesia must :

Article 5

(1) Health certificate as referred to in Article 2 letter a, Article 3 letter a and Article 4 letter a may be in form animal health certificate intended for type of animal or sanitation certificate intended for type of material derived from animal and animal product material.

(2) Animal health certificate as referred to in point (1) at least shall contain the following information :

(3) Sanitation certificate as referred to in point (1) at least contain the following information :

(4) Certificate of origin as referred to in Article 2 letter b, Article 3 letter b and Article 4 letter b is intended for other thing, which at least shall contain information of: product, country, area or area of origin and sanitation treatment.

(5) A certain period of time where there will be no quarantine animal pest in a country, area or place of origin of carrier media that must be included in the health certificate as referred to in point (2) and point (3) is stipulated with Ministerial Decree.

Article 6

(1) Report as referred to in Article 2 letter a and d, Article 3 letter d and Article 4 letter d for animal must be submitted at least two (2) days before entry or excretion, and for material derive from animal, animal product material and other thing must be submitted at least one (one) day before departure.

(2) Particularly for carrier media entry brought in by passenger, report as referred to in point (1) must be submitted during entry period.

(3) Owner of carrier media that does not obey time period of report submission as referred to in point (1), on technical judgment, official readiness and or facility needed, animal quarantined veterinarian may postpone inspection.

(4) The carrier media that is not reported to quarantine official during entry or excretion.

Article 7

(1) Aside from requirement as referred to in Article 2, Article 3 and Article 4 in certain case, the Government may stipulate additional obligation.

(2) Additional obligation as referred to in point (1) is in form of technical requirement and or management on disease based on discipline of veterinary science.

(3) Additional obligation as referred to in point (1) shall be further regulated with Ministerial Decree.

CHAPTER III
QUARANTINE ACTION

PART ONE
GENERAL

Article 8

(1) Carrier media brought in, brought or delivered from one area to other area, internal transit and or excreted from territory of Republic of Indonesia shall be taken into quarantine action.

(2) Quarantine action in form of inspection , isolation, observation, treatment, detention, refusal, annihilation and release.

(3) Quarantine action to the carrier media that endangers people shall be coordinated with institution in charge of veterinary and zoological public health service.

Article 9

(1) Inspection as referred to in Article 8 point (2) must be done in order to know completeness and truth of the document and to detect quarantine animal pest or to check feasibility of quarantine facility and transportation means.

(2) Health check or sanitation of carrier media as referred to in point (1) shall be done in physical inspection by means of :

(3) Inspection as referred to in point (2) must be done through day time, except on certain condition and on doctors judgment, animal quarantine may be done through night time. 

(4) If inspection as referred to in point (2) cannot be diagnosed, quarantine veterinarian may continue inspection through laboratory check, pathology, biological test, diagnostic test or with technical and other method in accordance with development of science and technology.

(5) Inspection as referred to in point (4) must be done though appointed laboratory.

Article 10

(1) Isolation as referred to in Article 8 point (2) shall be done on part of, or whole of carrier media for observation, inspection and treatment with intention of prevention of infection of quarantine animal disease.

(2) Period for isolation shall depend on time period needed for observation, inspection and or treatment to the carrier media.

(3) Period for isolation as referred to in point (2) shall be used as basis for determination of quarantine period.

(4) Quarantine period as referred to in point (3) shall be applied, commencing from the carrier media is submitted by its owner to the quarantine official till completion of implementation of quarantine action to the carrier media.

Article 11

(1) Observation as referred to in Article 8 point (2) is done to detect quarantine animal pest further by observation of symptom of the quarantine animal pest at the carrier media during their isolation by using all entry-all excretion system.

(2) Aside from observation as referred to in point (1), observation may also be done to observe animal quarantine pest situation in certain country, area or place.

(3) Period for observation or observation period shall commence since observation is started and shall finish till observation is completed.

(4) Observation period as referred to in point (3) shall be stipulated by Ministerial Decree based on period of incubation and type of clinical disease and type of carrier media.

(5) Observation as referred to in point (1) shall be done on condition :

(6) Disease whose incubation is not known, type of pest and method of infection, non existence, or the pest is free in certain area or region in the Republic of Indonesia, observation period shall be further regulated by the Ministerial Decree.

Article 12

(1) Treatment as referred to in Article 8 point (2) is action for freeing and purifying carrier media from quarantine animal pest or from other action for preventive action, curative and promotion.

(2) Treatment as referred to in Article 1, shall only be done after carrier media has physically been checked beforehand and if it is proved that it will not disturb observation process and further inspection.

Article 13

(1) Change as referred to in Article 8 point (2) is done to the carrier media that has not fulfilled quarantine requirement as referred to in Article 2, Article 3, Article 4, Article 5, Article 6 and Article 7 or other document as stipulated by the other related Minister during entry, transit or excretion from territory of Republic of Indonesia.

(2) Detention as referred to in point (1) is done after physical inspection of the carrier media and it is predicted it does not carry in pest and spread the quarantine animal pest.

(3) During detention period, other quarantine action may be done to detect possibility of quarantine animal pest and other animal pest and or to prevent possibility of infection, according to quarantine veterinarian judgment.

Article 14

(1) Refusal as referred to in Article 8 point (2) shall be done to the carrier media which is entered into or entered from one area to other area within the territory of Republic of Indonesia, if :

(2) Refusal as referred to in point (1) and point (2) can be done to the transit carrier media and shall be excreted from an area to other area or out of territory of Republic of Indonesia.

(3) Refusal as referred to in point (1) and point (2) shall be done by or coordinated with the person in charge of entry place, transit or excretion soon after receiving advice from quarantine veterinarian.

(4) If time limit for refusal as referred to in point (1) is not determined in particular way, refusal shall be done on first hand.

Article 15

(1) Annihilation as referred to in Article 8 point (2) shall be done to carrier media entered into territory of Republic of Indonesia and or from a certain area within the territory of Republic of Indonesia, if :

(2) Annihilation as referred to in point (1) may be done to the carrier media unloaded during transit or when it is going to be excreted from one area to another area or outside of territory of Republic of Indonesia.

(3) Annihilation as referred to in point (1) and point (2) must be witnessed by police and by related official of other institution.

(4) Annihilation of carrier media done outside quarantine installation of entry point and or excretion point must first be consulted with local government.

Article 16

(1) Release as referred to in Article 8 point (2) must be done to the carrier media entered into territory of Republic of Indonesia and or from one area to another area within the territory of Republic of Indonesia and is given certificate of release when :

(2) Certification of release to the carrier media as referred to in point (1) is intended for veterinarian authorized in the designated area;

(3) Release as referred to in Article 8 point (2) is done to the carrier media to be excreted from one area to another area within the territory of Republic of Indonesia and then it is given health certificate when:

(4) Health Certificate is given to carrier media as referred to in point (3) is intended for quarantine official at the entry point of a country or designated area.

(5) Release certificate and health certificate as referred to in point (2) and point (4) must be issued by animal quarantined veterinarian within twenty four (24) after release.

(6) Certificate as referred to in point (5) is responsibility of animal quarantined veterinarian continuously.

Article 17

(1) In implementation of quarantine action, quarantine veterinarian may be assisted by or he may assign quarantine paramedic.

(2) Authority and responsibility of quarantine action is within the hand of animal quarantined veterinarian.

(3) Implementation of quarantine action by quarantine veterinarian must be based on profession of a veterinarian.

(4) Quarantine paramedic as referred to in point (1) in implementing his task is responsible to veterinarian.

PART TWO
ENTRY POINT

Article 18

Plan for entry of carrier media must be notified to quarantine official.

Article 19

(1) Carrier media entered into territory of republic of Indonesia from foreign country or within one area from other area within the territory of Republic of Indonesia as referred to in Article 2 and Article 3 must be checked, whether or not it is complete, true and have valid document and health must be checked by animal quarantined veterinarian on transportation means before being unloaded or passing check point.

(2) When health inspection as referred to in point (1) cannot be done on transportation means, carrier media can be checked up after unloading or passing entry point on condition that initial inspection has been done, except for animal with status of material loading.

(3) Particularly for carrier media brought in by passenger, inspection as referred to in point (1) can be done after unloading from transportation means or passing the entry point.

Article 20

Aside from document requirement as referred to in Article 2 letter a and b, Article 3 letter a and b and Article 7, carrier media entry must be equipped with :

Article 21

(1) If carrier media entry is not equipped with health certificate, sanitation certificate or certificate of origin as referred to in Article 2 letter a and b and Article 3 letter a and b, media entry shall be refused.

(2) Carrier media that is refused for entry as referred to in point (1) may be detained if :

(3) If owner cannot show animal health certificate, sanitation certificate or certificate of origin within limit time as referred to in point (2) letter a, carrier media shall be refused for entry.

(4) If refused carrier media as referred to in point (1) and point (3) is not immediately excreted from territory of Republic of Indonesia or from area designated by its owner within time limit of twenty (24) hours, it will be annihilated.

Article 22

(1) If carrier media is not equipped with certificate as referred to in Article 20 letter a, it will be detained on condition :

(2) Detention as referred to point (1) must be continued with isolation, observation and more intensive inspection, aside from technical requirement as determined.

(3) If provision as referred to in point (1) and point (2) is not fulfilled, carrier media shall be refused for entry.

(4) Time duration for detention as referred to in point (1) depends on time duration for quarantine action as referred to in point (2).

(5) If refused carrier media as referred to in point (3) is not immediately excreted from territory of Indonesia or from area designated by its owner within time limit of twenty four (24) days for animal, and three (3) days for material derived from animal or animal product material, it will be annihilated.

Article 23

(1) If carrier media entry does not fulfill additional obligation as referred to in Article 7 and other document as referred to in Article 20 letter b, it will be detained and its owner will be given time at most of seven (7) days.

(2) During detention period as referred to in point (1), other quarantine action may be taken in accordance with technical requirement as determined.

(3) If provision as referred to in point (1) is not fulfilled, carrier media shall be refused for entry.

Article 24

In case carrier media owner cannot provide transportation means within limit time as referred to in Article 21 letter (4) and Article 22 letter (5), the Minister may extend time duration in observation of entry risk and spreading of quarantine animal pest.

Article 25

(1) Inspection of animal on water transportation as referred to in Article 19 point (1) shall be done before it comes to a stop a anchorage point.

(2) If during inspection as referred to in point (1), quarantine animal pest is found; derived from a country, area or place where animal entry is prohibited or where quarantine animal pest of class I is infectious; mutation is found and is predicted as infection of quarantine animal pest of class I;

(3) To the transportation means as referred to in point (2) letter a and b, following action may be taken :

Article 26

(1) Inspection of animal health on air transportation as referred to in Article 19 point (1) is done immediately after the transportation means has landed.

(2) If in the inspection as referred to in point (1), symptom of quarantine animal pest is found; derived from a country, area, or from other place of the animal entry where it is prohibited; derived from a country, area or a place where quarantine animal pest class I is spreading; or mutation is found and predicted as cause of the infection of quarantine animal pest of class I, and then :

(3) To the air transportation means as referred to in point (2) letter a and b, following action shall be taken :

Article 27

(1) Inspection of animal health on land and railway transportation as referred to in Article 19 point (1) is done immediately after the transportation means have arrived at entry place.

(2) If in the inspection as referred to in point (1), symptom of quarantine animal pest is found; derived from a country, area, or from other place of the animal entry where it is prohibited; derived from a country, area or a place where quarantine animal pest class I is spreading; or mutation is found and predicted as cause of the infection of quarantine animal pest of class I, and then :

(3) To the land and railway transportation as referred to in point (2) letter a and b, following action shall be taken :

Article 28

(1) If in inspection of transportation means as referred to in Article 25 point (1), Article 26 point (1) and Article 27 point (1) quarantine animal pest of class I and risk of animal quarantined of class II pest spreading is not found, there is no animal derived from foreign country, area or from a place where animal entry is prohibited or where quarantine animal pest of class I is spreading; or mutation predicted to be caused by quarantine animal pest of class I, after cleaning from ecto-parasite, the animals :

(2) Transportation as referred to in point (1) letter a and b is done under supervision of quarantine official.

Article 29

(1) During quarantine action as referred to in Article 28 point (1) letter a and c, animal can take further inspection as referred to in Article 9 point (4) for further detection of possibility of quarantine animal pest.

(2) If in the inspection during quarantine action as referred to in point (1), quarantine animal pest of class I is found, all animals pronged to and material or equipment associated with the animal must be annihilated.

(3) Material or equipment that is not possible to be annihilated as referred to in point (2) and to people, there must be pest purification.

(4) If in the quarantine action as referred to in point (1), quarantine animal pest of class II is found, sick animal must be isolated, dead animal is annihilated and quarantine duration is extended until condition is safe and there is no potential to carry in and spread in quarantine animal pest, on condition :

(5) If in implementation of quarantine action as referred to in point (1), symptom of animal pest in individual character is found, and other infectious disease aside from quarantine animal pest, then :

(6) After animal has undergone quarantine duration, the animal is not infectious and free from animal quarantine pest, the animal shall be released and is given release certificate after fulfillment of other obligation.

Article 30

(1) Health inspection of material derived from animal, animal product material and other thing on transportation means as referred to in Article 19 point (1) is done after the transportation means has anchored, landed or arrived at entry point.

(2) If health inspection to material derived from animal, animal product material and other thing on transportation means as referred to in Article 19 point (1) is not possible, then inspection may be done after animal is unloaded at entry point or at quarantine installation after condition is safe to that and there seems no potential to carry in and spread of quarantine animal pest.

(3) If during health inspection as referred to in point (1) and point (2), it is found that material derived from animal, animal product material and other thing:

(4) If refusal as referred to in point (3) letter a and letter b cannot be or it is not possible to do so, material derived from animal, animal product material and other thing must be annihilate.

(5) Material derived from animal, animal product material and other thing well treated as referred to in point (3) letter b, the animal shall be released and be given certificate after fulfillment of other obligation set out, as long it does not need further inspection as referred to in Article 9 point (4).

Article 31

If during health inspection as referred to in Article 30 point (1) and point (2), material derived from animal is found, animal product material and other thing :

Article 32

(1) If during inspection as referred to in Article 30 point (1) and point (2), it needs further inspection as referred to in Article 9 point (4) and or it does not fulfill technical requirement as referred to in Article 7, it will be retained at entry point or at quarantine installation.

(2) If during further inspection as referred to in point (1), pest endangers animal health is found and or people health, it must be annihilated.

(3) If technical requirement as referred to in Article 7 cannot be fulfilled, it must be refused.

(4) If during further inspection as referred to in point (1), pest endangers to animal health and or human health is not found, the animal must be released and be given release certificate after fulfillment of other obligation.

Article 33

(1) People, transportation means, material or equipment, packing and other load associated previously with and contaminated by the refused or annihilated carrier media as referred to in Article 30 point (3) and point (4) and Article 32 point (2) and point (3), shall also be treated and or be given quarantine action to prevent quarantine animal pest spreading.

(2) Treatment, detention, refusal, annihilation and release as referred to in Article 30 point (3), point (4) and point (5), Article 31 and Article 32 where in accordance with quarantine veterinarian it must be done to all or a part of carrier media entry.

PART THREE
TRANSIT

Article 34

(1) In order to prevent quarantine animal pest enter into territory of Republic of Indonesia from foreign country through transit of transportation means that carrys in animal from foreign country, transit shall only be approved at designated place.

(2) Approval of transit at transit places as referred to in point (1) shall be stipulated by Ministerial Decree.

(3) In stipulating Decree as referred to in point (2), the Minister must consider situation of quarantine animal pest in the country origin and or at other previous transit places and possibility of spreading through the animal.

(4) Carrier media that is transited as referred to in point (10 shall fulfill the requirements of :

(5) Animal transfer from transit house to outside transit house must be approved by the Minister with safe guard from the quarantine.

(6) In case quarantine animal pest is found and quarantine action is to be taken, as referred to in point (4) letter c and letter e, it must be reported to the authorized official in the country origin and in the country destination.

Article 35

(1) In order to prevent entry of quarantine animal pest from foreign country into the territory of Republic of Indonesia through transit of transportation means that carrys in the animal, material derived from animal, animal product material and or other thing from foreign country, transit shall only be done at designated places and it must fulfill conditions of :

(2) In case sanitation does not fulfill condition and quarantine action done as referred to in letter (1) letter c, it must be reported to the authorized official in the country origin and in the country destination.

Article 36

(1) In order to ensure isolation of carrier media during transit, person in charge of transit house may determine location and provide facility for transit of carrier media derived from foreign country and that will be loaded into other transportation means on approval of quarantine veterinarian.

(2) If international traffic set out condition for direct transit location facility, in fulfilling that requirement, person in charge of transit house must consider advice from quarantine veterinarian in order to prevent quarantine animal pest infection, particularly infection caused by insect.

Article 37

(1) If country destination sets out condition for transit certificate, quarantine veterinarian may issue the certificate.

(2) Transit certificate as referred to in point (1) shall at least certify health status or sanitation status of the carrier media, quarantine action and safe guard that was previously done during transit within the territory of Republic of Indonesia and other certification needed by country destination.

Article 38

(1) In order to prevent quarantine animal pest through transit transportation that carrys in carrier media from one area to other area within the territory of Republic of Indonesia, transit shall only be done at places or areas designated.

(2) Transit places as referred to in point (1) and area prohibited for transit shall be stipulated by Ministerial Decree.

(3) In stipulation as referred to in point (2), the Minister must consider situation map of the quarantine animal pest, traffic route, risk analysis and official readiness and facility and existing infrastructure.

(4) If violation takes place to regulation as referred to in point (2), person in charge of transit house shall refuse transit transportation to transit the animal on advice of quarantine veterinarian.

(5) If violation takes place to regulation as referred to in point (2) at the excretion point at the transit place prohibited or at entry point of area destination, there must be detention and it must be followed up in accordance with prevailing regulation.

PART FOUR
EXCRETION

Article 39

Plan to excrete carrier media must be submitted by the owner to the quarantine official.

Article 40

(1) Carrier media excreted out of territory of republic of Indonesia to foreign country or to other area within the territory of Republic of Indonesia as referred to in Article 3 and Article 4, its document must be checked, truth and validity of the quarantine document and animal health by quarantine veterinarian in the excretion point, quarantine installation or at area origin before being loaded into the transportation means that transport the carrier media from excretion point.

(2) If carrier media must undergo quarantine action intensively, health inspection as referred to in point (1) must be done at quarantine installation.

Article 41

(1) Carrier media excreted out of area origin to excretion point must be equipped animal health certificate, sanitation certificate or certificate of origin and other document.

(2) Animal health certificate or sanitation certificate as referred to in point (1), its issuance may also be issued by veterinarian appointed by the Minister aside from the quarantine veterinarian after considering professional organization.

(3) In appointment of veterinarian as referred to in point (2), the Minister must consider situation of quarantine animal pest in the area or area origin, diseases safe guard method, cultivation technology, safe guard or product processing in accordance with prevailing regulation.

(4) Pet animal whose health is always supervised by veterinarian in routine manner or by group of veterinarian, the animal health certificate as referred to in point (1) may be issued by veterinarian or group of related veterinarian.

Article 42

(1) If excretion of carrier media is not in accordance with health certificate, sanitation certificate or certificate of origin as referred to in Article 40 point (1), its excretion must be refused and it must be returned to its owner.

(2) Pet animal, material derived from animal, animal product material or animal product material not intended for consumption that must be brought in by passenger may be given health certificate or sanitation certificate after first be checked up in its health by quarantine veterinarian at excretion point on condition that :

Article 43

If excretion of carrier media does not fulfill additional obligation as referred to in Article 7 and other document as referred to in Article 41 point (1), then :

Article 44

(1) Animal health inspection at excretion point, quarantine installation or place of origin as referred to in Article 40 point (1) and point (2), must be done immediately after submission by its owner.

(2) If during inspection as referred to in point (1), symptom of quarantine animal pest is found, it is derived from the area or place where animal excretion is prohibited, or from area where quarantine animal pest is spreading, then :

Article 45

If during inspection as referred to in Article 44 point (1), symptom of quarantine animal pest is not found, it is not derived from area or place where animal excretion is prohibited, or from area or place where quarantine animal pest is spreading, then :

Article 46

(1) During quarantine action as referred to in Article 45 letter a, further inspection may be continued as referred to in Article 9 letter (4) for further quarantine animal pest detection.

(2) If during quarantine action as referred to in point (1) symptom of quarantine animal pest of class I is found, all animals pronged to and material or equipment which are once associated with the animal must be annihilated.

(3) To the material or equipment that is not possible to be annihilated as referred to in point (2) and to people, they must be pest purified.

(4) If during implementation of quarantine action as referred to in point (1), symptom of quarantine animal pest of class II is found, dead animal must be annihilated, sick animal must be isolated and quarantine period must be extended or its departure must be postponed until it is safe and it does not have potential to carry in and spread quarantine animal pest on condition that:

(5) If in implementation of quarantine action as referred to in point (1), symptom of quarantine animal pest in individual form is found or other infectious animal pest aside from quarantine animal pest, then

(6) If animal has finished undergoing quarantine period, and it is not infectious and free from symptom of quarantine animal pest, the animal must be freed and is given health certificate after fulfilling other obligation.

Article 47

(1) In freeing the animal, veterinarian, besides having detected the animal which is proved to be free from quarantine animal pest, the veterinarian must consider feasibility of animal physical condition for departure before being loaded into transportation means.

(2) Quarantine veterinarian must refuse departure of the animal when the animal physically not feasible to do so.

(3) Implementation of animal transportation from quarantine installation to the transportation means must be directly done under supervision of quarantine official.

Article 48

(1) Health inspection to the material derived from animal, animal product material and other animal at excretion point, quarantine installation or at place of origin as referred to in Article 40 point (1) and point (2) immediately after material derived from animal, animal product material and other thing is submitted to the owner.

(2) If during inspection as referred to in point (1), material derived from animal, animal product material and other thing :

(3) To material derived from animal, animal product material and other thing that is successful in treatment as referred to in point (2) letter b may be freed and is given sanitation certificate after fulfillment of other obligation, as long as it does not need further inspection as referred to in Article 9 point (4).

Article 49

If during inspection as referred to in Article 48 point (1), it is found that material derived from animal, animal product material and other thing :

Article 50

(1) If during inspection as referred to in Article 48 point (1), it needs further inspection as referred to in Article 9 point (4), and it does not meet technical requirement and or does not fulfill requirement set out by country destination, it may be detained at place of origin, at quarantine installation or at excretion point.

(2) If during further inspection as referred to in point (1), pest that can endanger animal health and or people health is found, then it must be annihilated.

(3) If technical requirement and or requirement set out by country destination cannot be fulfilled, its excretion must be refused and it must be returned to the owner.

Article 51

(1) People, transportation means, material or equipment, packing and other load that is once associated with or contaminated with carrier media, that is refused or annihilated as referred to in Article 48 point (2) and Article 50 point (2), that is treated and or taken quarantine action to prevent quarantine animal pest spreading.

(2) Treatment, detention, annihilation, refusal and freeing as referred to in Article 48 point (2) and point (3), Article 49 and Article 50, which according to quarantine veterinarian judgment, can be done to all or part of carrier media that will be delivered.

PART FIVE
QUARANTINE ACTION TO TRANSPORTATION MEANS

Article 52

(1) In implementation of quarantine action, person in charge of transportation means must report arrival of transportation means to quarantine official at the entry point on condition :

(2) When transportation means as referred to in point (1) arrives at entry point, person in charge of transportation means must report on its load and traffic route passed to quarantine official at entry point.

Article 53

(1) If report from responsible party as referred in Article 52 point (1) and point (2) and or from inspection result, transportation means has potential to carry in and spread quarantine animal pest, quarantine official may take treatment action.

(2) Treatment done to transportation means as referred to in point (2) shall also be imposed to passenger and other load.

(3) Treatment method to transportation means, passenger and other load must be further regulated with Ministerial Decree.

Article 54

(1) Person in charge of transportation means and who will load carrier media must first check whether all conditions and requirements as set out by quarantine of the carrier media have been fulfilled.

(2) Person in charge of transportation is prohibited from transporting carrier media that has not fulfilled conditions and quarantine requirement as referred to in point (1).

Article 55

(1) In order to prevent exploitation, stress and disturbance to the animal welfare; damage and contamination to material derived from animal, animal product material and other thing; and or quarantine animal pest infection as result of transportation, we need technical requirement for transportation means and packing of carrier media.

(2) Quarantine official must carry out checking on feasibility of transportation means and carrier media in accordance with technical requirement as referred to in point (1) before being loaded in the excretion point.

(3) If during inspection as referred to in point (2) we find that transportation means ad or packing of carrier media does not fulfill technical requirement, loading of carrier media must be canceled or postponed until the technical requirement is fulfilled.

(4) Technical requirement for transportation means of the carrier media is stipulated with the Ministerial Decree after consultation with the responsible Minister in the communication field.

PART SIX
QUARANTINE ACTION TO OTHER CARRIER MEDIA

Article 56

(1) Other carrier media in form of rubbish, passenger food remain, manure, woof remain and animal carcass and goods or material once associated with animal unloaded from transportation means at entry point or transit house, must be annihilated by person in charge of transportation means under supervision of quarantine official.

(2) Other carrier media like food remain or product that does not fulfill quarantine requirement and has been brought by passenger unintentionally to the entry point must be thrown away at quarantine rubbish disposal.

(3) Rubbish annihilation as referred to in point (1) and point (2) must be done within the entry point area.

(4) requirements as referred to in point (1), point (20 and point (3) must be done through coordination and assistance from person in charge of entry point.

(5) Other carrier media like equipment remain and equipment owned by people assumed to carry in and spread quarantine animal pest must be treated.

PART SEVEN
QUARANTINE ACTION TO OUTSIDE OF ENTRY POINT AND EXCRETION POINT

Article 57

(1) In order to facilitate services and smoothness of goods flow at entry point and or at excretion point, quarantine action may be done outside the entry point or outside of excretion point and outside of quarantine installation, as long as it does not contradict with animal quarantine principle and prevailing regulation.

(2) Quarantine as referred to in point (1) can be calculated as part of the process of implementation of quarantine action at the quarantine installation, entry point and excretion point based on risk analysis of quarantine animal pest.

Article 58

(1) In case of entry, implementation of quarantine action as referred to in Article 57 point (1), it can be done in a country, area or place of origin, in country or transit area, on transportation means of the carrier media during journey to the entry point and or destination point.

(2) In case of excretion, implementation of quarantine action as referred to in Article 57 point (1), it can be done in area or place of origin, and or on transportation means of the carrier media during journey to the excretion point and.

(3) Implementation of quarantine action as referred to in point (1) can only be done on approval of Minister or in accordance with technical requirement.

(4) Implementation of quarantine action as referred to in point (2) can be done on advice of quarantine veterinarian as long area or place of origin is stated to have been free from quarantine animal pest that can be infected through the carrier media.

Article 59

(1) Quarantine action to the animal seeding, biological reproduction and animal of breeding result can be facilitated in the entry point and or excretion point through the status health evaluation and situation of quarantine animal pest in the place of origin, in accordance with quarantine work method.

(2) Quarantine action to material derived from animal, animal product material and other thing can be facilitated at the entry point and or at excretion point through the sanitation status evaluation and situation of quarantine animal pest of place of origin, in accordance with quarantine work method.

(3) Evaluation method as referred to in point (1) and point (2) shall be further stipulated with Ministerial Decree.

Article 60

(1) In order to support quarantine action outside to entry point, outside of excretion point and or at quarantine installation as referred to in Article 57, Article 58 and Article 59, other party may assist implementation of quarantine action.

(2) Implementation of quarantine action by other party as referred to in point (1) must be reported to the quarantine veterinarian.

(3) Appointment of other party as referred to in point (1) shall be regulated with Ministerial Decree , in accordance with prevailing regulation in observation of authorization of profession of veterinarian.

Article 61

(1) In order to prevent quarantine animal pest into territory of Republic of Indonesia, status evaluation or supervision of implementation of quarantine action and technical requirement can be done at country origin or transit house which has high risk.

(2) Authorized official at country origin or transit house must be notified before assigning quarantine veterinarian as referred to in point (1).

(3) Method of supervision of quarantine action and technical requirement as referred to in point (1) shall be further regulated with Ministerial Decree.

Article 62

(1) Evaluation on status or situation of quarantine animal pest and or supervision of implementation of quarantine action and technical requirement in whole or in part of territory of Republic of Indonesia can be done by official of the country destination to fulfill technical requirement and risk analysis to the carrying in of quarantine animal pest.

(2) Official of country destination as referred to in point (1) must inform the Minister before conducting evaluation.

PART EIGHT
QUARANTINE ACTION TO DELIVERY THROUGH POST

Article 63

(1) Delivery of carrier media through post or through courier service must include clearly of amount, or name of carrier media and country or area of origin in accordance with prevailing regulation.

(2) Method of delivery of carrier media through post through courier service as referred to in point (1) must be further regulated with Ministerial Decree after consultation with responsible Minister in post sector.

PART NINE
QUARANTINE ACTION
IN EMERGENCY SITUATION

Article 64

(1) If water way transportation, air or land and railway transportation that is loaded with carrier media, in emergency situation anchors at or lands at or stops at place non designated for the purpose as entry point or excretion point, person in charge of transportation means or who know the incident as mentioned above, must report it immediately to quarantine official, veterinarian or nearest government official.

(2) Veterinarian and government official who receives the report as referred to in point (1) must report it immediately to the nearest quarantine official.

(3) Carrier media, material or equipment and other load once associated with the carrier media is prohibited from unloading from the transportation means before being permitted by quarantine official, except for emergency reason.

(4) In case of transportation means as referred to in point (1) cannot continue their journey, the carrier media must be taken quarantine action in accordance with entry regulation.

(5) In case of transportation means as referred to in point (1) can continue their journey, the carrier media must be taken quarantine action in accordance with transit regulation.

PART TEN
QUARANTINE ACTION TO REFUSAL BY COUNTRY DESTINATION

Article 65

(1) Re-entry of carrier media that is refused by foreign country because it cannot fulfill requirement, requirement set out by country destination, infection of quarantine animal pest and or other reason, is taken quarantine action in accordance with entry regulation.

(2) Re-entry of carrier media as referred to in point (1) must be equipped with refusal certificate from country destination and give reason for refusal.

(3) Health certificate that accompanies carrier media during excretion period can be used again as quarantine requirement.

(4) Re-entry of carrier media as referred to in point (1) caused by reason of non fulfillment of quarantine requirement during excretion period must be annihilated at entry point or at quarantine installation.

(5) Minister may consider annihilation action as referred to in point (4) when carrier media is included into the one preserved by Law.

PART ELEVEN
QUARANTINE ACTION TO DETAINED GOODS

Article 66

(1) Animal quarantine official is authorized to take quarantine action to the carrier media whose status is detained goods or evidence material during legal prosecution before being delivered to official or to authorized institution in order to prevent spreading of quarantine animal pest.

(2) In case of quarantine action as referred to in point (1) in form of annihilation, Minutes of Annihilation can be made as evidence by official or authorized institution.

Article 67

(1) Quarantine official authorized to implement quarantine action to the carrier media that is stated as goods of non controlled, that is controlled by state and that belongs to state, since the carrier media belongs to thing that cannot last long, easily broken or easily rotten and can endanger animal health and or people health.

(2) In case carrier media has become state belonging as referred to in pint (1), quarantine veterinarian advice is given in accordance with prevailing regulation.

Article 68

(1) Quarantine official may lock, seal and or attach safety label to the carrier media to prevent action that may put us in difficulty or hamper implementation of quarantine action.

(2) It is prohibited to open, release or damage the lock, seal or safety seal as attached, as referred to in point (1) before quarantine process is completed without approval from quarantine veterinarian.

PART TWELVE
QUARANTINE ACTION TO PASSENGER GOODS

Article 69

(1) Carrier media from a country, area or place that is not prohibited, people may carry their belonging for their own purpose.

(2) Carrier media that brought in as belonging goods as referred to in point (10 can be free from quarantine requirement after health inspection and after considering quarantine animal pest risk spreading in accordance with prevailing regulation.

(3) Provision on quantity, type and method of entry, transit or excretion of the carrier media as referred to in point (1) shall be stipulated by Ministerial Decree.

PART THIRTEEN
SPECIAL QUARANTINE ACTION

Article 70

Provisions in this Government Regulation applies for entry, transit or excretion of carrier media that is brought in or sent to as diplomatic goods.

Article 71

(1) Organic animal may be excepted from this Government Regulation as long as it follows requirement :

(2) Method of quarantine, particularly for organic animal as referred to in point (1) shall be further regulated by Ministerial Decree.

CHAPTER IV
QUARANTINE SERVICE FEE

Article 72

(1) Quarantine service fee consists of use of facility or infrastructure owned by the Government and fee for implementation of quarantine action to the animal, material derived from animal, animal product material, other thing, other carrier media and transportation means.

(2) Revenue derived from contribution as referred to in point (10 is state revenue of non taxable and must be paid to state treasury.

CHAPTER V
QUARANTINE ENVIRONMENT

Article 73

(1) Determination of areas within territory of Republic of Indonesia is based on status, situation and epidemiology of quarantine animal pest in observation of social economy and local culture.

(2) Areas as determined in point (1) is used as basic for policy making, regulation and supervision of carrier media traffic.

(3) Areas as referred to in point (1) is stipulated by Ministerial Decree.

Article 74

(1) In case it is found or there is indication that quarantine animal pest exists in one location, firstly it was known to be free from the pest, then the location is classified or is categorized as one stipulated area of infectious animal disease.

(2) In case there occurs animal infectious disease epidemic as referred to in point (1), area or part of the area as referred to in Article 73 point (3) can be stated, for the time being as quarantine area.

(3) Regulation on entry and or excretion of carrier media from and to other epidemic area, is stipulated on prevailing regulation and is used as technical requirement for implementation of quarantine action.

(4) Quarantine official in all quarantine areas must make maximum supervision in every entry point and excretion point and coordinate with institution responsible to handle the animal disease epidemic.

(5) In order to prevent epidemic area extension, quarantine area as referred to in point (20 is stipulated by Ministerial Decree.

CHAPTER VI
TYPE OF QUARANTINE ANIMAL PEST AND CARRIER MEDIA

FIRST PART
TYPE OF QUARANTINE ANIMAL PEST

Article 75

(1) Quarantine animal pest is classified into quarantine animal pest of class I and quarantine animal pest of class II based on epidemic power and disease patogenity, social economic impact and its situation in an area or territory of Republic of Indonesia.

(2) Classification of quarantine animal pest of class I and class II as referred to in point (1) and stipulation of type of sensitive animal, method of infection, incubation period, observation period, quarantine period, testing standard and treatment is stipulated by Ministerial Decree.

Article 76

(1) Quarantine policy and limitation of carrier media traffic is regulated on quarantine animal pest classification and mapping of quarantine animal pest.

(2) Mapping of quarantine animal pest as referred to in point (10 shows status of a country, area or place, derived from observation activity.

(3) Observation activity as referred to in point (2) can be done directly at entry point, transit, excretion, quarantine installation and transportation means indirectly at other place by involving or getting information from authorized party in that activity.

PART TWO
TYPE OF CARRIER MEDIA

Article 77

(1) Carrier media may be classified based on prong, method of infection and method of detection of quarantine animal pest.

(2) Carrier media classification for quarantine purpose as referred to in point (1) is further regulated by Ministerial Decree.

Article 78

(1) It is prohibited to put into or excrete carrier media or transit in a country or area that is still be spread by quarantine animal pest of class I, and or quarantine animal pest of class II.

(2) Entry prohibition, transit or excretion carrier media as referred to in point (1) is stipulated by Ministerial Decree.

CHAPTER VII
ENTRY POINT AND EXCRETION POINT

Article 79

(1) Entry point, transit or excretion point for carrier media within the territory of Republic of Indonesia is based on status and situation of quarantine animal pest for import, inter area and export.

(2) Entry point, transit or excretion for carrier media as referred to in point (1) is stipulated with Ministerial Decree after consultation with the Minister responsible to communication field.

CHAPTER VIII
QUARANTINE INSTALLATION

Article 80

(1) In order to prevent entry, spreading or excretion of quarantine animal pest, government and other party may provide quarantine installation inside and outside of entry point or excretion point in accordance with technical requirement needed for quarantine action.

(2) In stipulation of technical requirement of quarantine installation as referred to in point (1) we must observe risk of quarantine animal pest spreading, animal welfare or product safety, social culture and environment.

(3) Determination of quarantine installation outside of entry point or excretion point as referred to in point (1), aside from observation of technical requirement as referred to in point (2), must also be consulted with local government.

(4) Technical requirement and quarantine installation as referred to in point (2) and point (3) is stipulated with Ministerial Decree.

Article 81

(1) If quarantine capacity as referred to in Article 80 point (4) cannot accommodate all carrier media, veterinarian may approve temporary expansion and addition of building or existing facility on account of carrier media owner.

(2) If quarantine action cannot be done at government quarantine installation set out, as referred to in Article 80 point (4) since its capacity is inadequate, being used or the quarantine is not feasible to be used, the Minister may appoint other party s quarantine for temporary period and it may only be used once or for several times for stage delivery.

(3) If quarantine action cannot be done because government quarantine facility for type of carrier media as referred to in Article 80 point (4) is not ready or it is not possible to be ready, the Minister may appoint other partys quarantine installation for permanent use, as long as it still fulfills technical requirement.

Article 82

(1) Carrier media that has potential for animal quarantine pest spreading and has infectious character and method for detection need a relative long period, then quarantine action is taken at the quarantine installation after entry.

(2) Quarantine installation after entry and implementation of quarantine action as referred to in point (1) is stipulated with Ministerial Decree.

Article 83

(1) Particularly for implementation of quarantine action to the wild animal that is bred in method of in-situ and ex-situ, quarantine action after entry as referred to in Article 82 point (1) is done routinely at the maintenance place or breeding place.

(2) All area for maintenance and breeding of wild animal as referred to in point (1) is stipulated as quarantine installation after entry in permanent manner, is stipulated with Ministerial Decree.

Article 84

(1) For national purpose, we may enter type of animal pronged to disease from a country, area or place that is still being spread with quarantine animal pest with maximum safety at a certain place with border that can be accounted for in accordance with international rule as quarantine installation with maximum safety.

(2) Quarantine installation with maximum safety and its safety method is as provided in point (1) is stipulated with Ministerial Decree.

Article 85

(1) Entry of carrier media with high risk for quarantine animal pest into territory of republic of Indonesia can be stipulated with obligation in form of approval from quarantine installation from country origin or transit after being considered, based on quarantine veterinarian judgment.

(2) The quarantine veterinarian judgment as contemplated in point (1), must be based on the technical requirements as contemplated in Article 80 point (2).

(3) Authorized official at country origin or transit must be notified before assigning quarantine veterinarian to evaluate situation and condition.

(4) Approval from quarantine installation in the country origin or transit as refereed to in point (1) is stipulated with Ministerial Decree.

CHAPTER IX
PUBLIC PARTICIPATION AND COOPERATION BETWEEN COUNTRY

Article 86

In an effort to increase awareness and public participation in animal quarantine field, we may provide education, training, guidance and spreading information in systematic manner by involving professional organization, functional organization and public self supporting agency.

Article 87

(1) In carrying out strategy in order to prevent entry of carrier media assumed to carry in and spread of quarantine animal pest or animal quarantine activity, we invite public participation in large scale.

(2) Public participation in carrying out strategy as referred to in point (1) is further stipulated with Ministerial Decree.

Article 88

(1) Cooperation with other country in animal quarantine can be done in bilateral form, regional and or multi lateral.

(2) Cooperation with other country in animal quarantine as referred to in point (1) is further stipulated with Ministerial Decree after consultation with other related Minister.

CHAPTER X
OFFICIAL AND QUARANTINE FACILITY

Article 89

(1) Implementation of quarantine action is done by quarantine official.

(2) Quarantine officials consist of quarantine veterinarian and quarantine paramedic, appointed and terminated by Minister.

(3) Quarantine official is functional official, requirement of which is stipulated in accordance with prevailing regulation.

(4) Quarantine official may support smooth operation of carrier media related to quarantine task through special assignment by the Minister or other related Minister.

Article 90

(1) In implementation of quarantine action, quarantine official as referred to in Article 89 point (2) is also authorized to :

(2) Aside authorization in quarantine field as referred to in point (1), quarantine official and quarantine veterinarian is also authorized in animal health and veterinary public health on the transportation means, quarantine installation or places within the entry point or excretion point.

Article 91

Criminal investigation in animal quarantine may be done by quarantine official who is specially authorized as government official in charge of investigation in accordance with prevailing regulation.

Article 92

(1) Instruction and decision by quarantine veterinarian or implementation of quarantine action must be done in writing in form of quarantine document.

(2) Provision of quarantine document as referred to in point (1) is further stipulated with Ministerial Decree.

(3) In order to support smooth operation of goods flow at entry point or excretion point, quarantine document may be submitted directly by quarantine official who issues it through electronic facility.

Article 93

(1) Care and or maintenance of carrier media during quarantine period or detention must be responsibility of its owner.

(2) If in implementation of quarantine action, there occurs damage in quarantine installation by quarantine services user, repair must be for account of user.

(3) If implementation of quarantine is outside of quarantine official position, any matter to support his task shall be for account of carrier media owner.

Article 94

(1) In implementation of his task, quarantine veterinarian must observe ethical code of quarantine veterinarian

(2) After quarantine veterinarian has accomplished his task adequately in accordance with his responsibility as a professional veterinarian as referred to in Article 17 point (3), loss incurred to as result of implementation of quarantine action, cannot be accounted for to the government or to the quarantine veterinarian.

(3) If quarantine veterinarian cannot accomplish his task adequately and is categorized as ethical violation and or professional violation, Minister may impose sanction to the quarantine veterinarian after getting consideration from professional organization, and option is open for any possibility for civil or criminal charge.

CHAPTER XI
TRANSITIONAL PROVISION

Article 95

All implementation regulation under this Government Regulation that is related with animal quarantine is still valid as long as it is not in contradiction or new regulation is not enacted yet, based on this Government Regulation.

CHAPTER XII
CLOSING PROVISION

Article 96

With the enactment of this Law, provisions in Law Number 15 year 1977 on Refusal, Prevention, Limit and Medication of Animal Pest, as long as it deals with refusal and animal quarantine is not valid anymore.

Article 97

This Law comes into effect at the time this Regulation is enacted.

In order that anybody knows this Law, we instruct this Law to be placed in the State Gazette of republic of Indonesia.
